Terms of Service

1. The Service

1.1 What we provide. TVVV is an online platform for creating images, videos, voice-overs, music and text with AI, including an infinite node canvas, single-purpose generation tools, a timeline editor, and a remote MCP server / API that lets AI agents use the Service on your behalf. The Service is a digital software-as-a-service product delivered over the internet.

1.2 Nature of the Service. The Service is digital and intangible. Purchased credits are added to your account immediately after payment is confirmed. Because of this immediate delivery, refunds are subject to the rules in section 7.

1.3 Third-party AI models. Generation is performed by third-party AI model providers. Each model is shown by its real name in the model selector (for example, Seedance, Seedream, Wan, Kling, Nano Banana, GPT Image and Fish Audio, depending on current availability). The quality, speed and availability of Outputs depend on these providers; models may be added, changed or withdrawn, and we will show a notice in the interface when a model is unavailable. TVVV is an independent product and is not affiliated with or endorsed by these providers.

2. Accounts

2.1 Creating an account. You can register with an email address and password or with Google sign-in. You must provide accurate information and keep it up to date. You are responsible for keeping your login details confidential and for all activity under your account.

2.2 Security. Do not share your login details with anyone. If you suspect unauthorized use, contact jameswest8823@gmail.com immediately.

2.3 Organizations. If you register on behalf of a company or organization, you confirm that you are authorized to bind it to these Terms.

2.4 Free credits. New accounts may receive a small amount of free starter credits. Free credits have no cash value, cannot be transferred and are not refundable, and we may limit them to prevent abuse (for example, multiple accounts).

3. API keys, MCP and agents

• You can create API keys on the MCP page to connect AI agents (such as Cursor or Claude) to the Service. A key is shown only once, when it is created; we store only a hash of it.
• Everything done with your API keys counts as use of your account: generations made through a key are charged to your credit balance, and you are responsible for the actions of any agent you connect.
• Keep keys secret. Do not embed them in public code or share them. You can revoke a key at any time, and you must revoke it if you believe it has been exposed.
• We may rate-limit, suspend or revoke keys that are used abusively or in breach of these Terms.

4. Credits and pricing

The Service uses credits. You can buy credit packs with a one-time payment, or subscribe to a membership (monthly or yearly, renewing automatically until you cancel) or the Team plan (yearly) to receive credits each period. Each generation deducts whole credits (rounded up, minimum 1) according to the model and settings you choose: images, video, speech and music are charged the price shown before you generate, and text chat is charged by actual usage. The required credits are reserved before a generation is submitted; if your available credits are not enough, nothing is submitted; failed generations release the reservation and are not charged; your balance never goes below zero. Your usage history shows every charge. Current packs and prices are shown on the pricing page.

We may change pack prices or the credit cost of models in the future. Changes apply only to purchases and generations made after the change and never reduce credits you have already bought.

5. Billing and payment

5.1 Payment authorization. By completing a purchase you authorize us (or our payment processor or merchant of record) to charge your payment method the amount shown at checkout. Credit packs are one-time purchases. Memberships renew automatically for the billing period you chose until you cancel; after canceling, the membership stays active until the end of the paid period. We do not offer automatic top-ups.

5.2 Payment processors. Payments are processed by Stripe and, where indicated at checkout, by Waffo Pancake acting as merchant of record. Where a merchant of record is used, it is the seller of record for that transaction and its name may appear on your card statement. Card data is handled by these PCI-DSS compliant processors and never stored on our servers.

5.3 Taxes. Unless stated otherwise, prices do not include applicable taxes (such as VAT, GST or sales tax). Where required, taxes are calculated and collected at checkout.

5.4 Receipts and invoices. A receipt is issued for every purchase. If you need an invoice, email jameswest8823@gmail.com with your account email and the purchase date.

5.5 Redeem codes. Credits may also be added with redeem codes. Codes are single-use, have no cash value, and refunds for codes bought from a reseller must be requested from that reseller.

6. Credit validity and account termination

6.1 Validity (from October 4, 2026). How long credits last depends on where they come from:

• Subscription credits: credits included with Member / Premium plans are valid for the current cycle only. Monthly plans reset at each renewal; yearly plans receive credits once a month and reset at the next monthly grant. Unused subscription credits do not roll over. If you cancel, they remain usable until the end of the paid period and then expire.
• Team credits: each seat's monthly credits go into the company pool, are valid for that month and reset at the next monthly grant. If the Team plan lapses, the pool is frozen and credits keep expiring on their dates.
• Purchased credits: credits from credit packs, Team top-up packs and redeem codes (including credits bought by Super Creators) are valid for 90 days from purchase, regardless of whether you keep a subscription.
• Promotional credits: sign-up, promotional and compensation credits show their expiry date when issued (currently 90 days after issue).
• Spending order: subscription credits are used first, then other credits by expiry date, soonest first.
• Credits already in your account before October 4, 2026 are not affected by this section and do not expire while your account remains open.
• You can see the remaining amount and expiry date of each batch of credits under Account → Membership & credits. Expired credits are not refundable unless applicable law requires otherwise.

6.2 Termination. If you delete your account, any remaining credits are forfeited, so please request a refund of eligible credits under section 7 before deleting. If we terminate your account for a breach of these Terms (including the Acceptable Use Policy in section 10), unused credits are forfeited and are not refunded unless applicable law requires otherwise. If we close your account or discontinue the Service for reasons other than your breach, we will refund the unused portion of your purchased credits.

7. Refund policy

Credits that have been used are generally not refundable. The following exceptions apply:

• Unused purchase within 7 days: if you request a refund within 7 days of a purchase and none of the credits from that purchase have been used, we will refund it in full.
• Duplicate or erroneous charges: charges made twice or in error because of a billing mistake are refunded in full.
• Failed generations: generations that fail are not charged. If credits were deducted for a generation that failed because of a technical error on our side or the model provider's side, contact us and we will restore those credits.
• Statutory rights: any right of withdrawal or refund that applicable law gives you (for example, the 14-day right of withdrawal for consumers in the EU, UK or Australia) is preserved. Where the law allows, this right ends once you start using purchased credits, and you agree that delivery begins immediately after purchase.

Free starter credits, credits from redeem codes and promotional credits are not refundable.

How to request a refund: email jameswest8823@gmail.com from your account email with the purchase date and the receipt or transaction ID. We will reply within 2 business days, and approved refunds are returned to the original payment method within 5–10 business days. The credits from a refunded purchase are removed from your balance.

8. Billing disputes

If you believe a charge is wrong, please email jameswest8823@gmail.com before opening a dispute with your bank. We will reply within 2 business days and fix confirmed billing errors within 5 business days.

9. AI content and intellectual property

9.1 Ownership of Outputs. As between you and us, and subject to these Terms, you own the content generated from your inputs ("Outputs"). You may use Outputs for any lawful purpose permitted by section 10, including commercial use, subject to the rights of third parties and any restrictions of the underlying model provider. Because AI systems can produce similar results for different users, Outputs may not be unique, and we do not guarantee that an Output is protectable by copyright in every country.

9.2 Your inputs. You keep ownership of the prompts, files and other content you submit ("Inputs"). You grant us a limited, non-exclusive license to host, process and transmit your Inputs and Outputs, including to third-party model providers, solely to provide the Service to you. We do not use your Inputs or Outputs to train AI models.

9.3 Your responsibility for Inputs. You confirm that you have all rights needed to submit your Inputs — including consent from any real person whose face, likeness or voice appears in them — and that your Inputs do not infringe anyone's rights.

9.4 Accuracy. AI-generated content can be inaccurate, incomplete or unexpected. Review Outputs before relying on or publishing them. We do not guarantee any particular result and are not responsible for content produced by third-party models.

9.5 Our platform. The Service itself, including its software, design and the TVVV name and logo, belongs to us or our licensors. These Terms do not give you any right to them other than to use the Service.

9.6 Storage period. Generated works and uploaded reference files are kept for 60 days from creation or upload for non-members, and for 180 days for Members, Premium members and Super Creators (based on your current plan, so upgrading extends the period for your existing works; works created before 2026-10-04 are counted from 2026-10-04). Each work shows how many days it has left; when the period ends the file is deleted and cannot be recovered, and the work is shown as "Expired" in your list. Please download anything you want to keep before it expires.

10. Acceptable Use Policy

10.1 Permitted use. You may use the Service only for lawful purposes and in line with these Terms.

10.2 Prohibited content. You must not use the Service to create, upload or distribute any of the following:

• Pornography / NSFW content: sexually explicit or pornographic material, including nudity created for sexual purposes.
• Violence / gore: graphic violence, gore, content that glorifies or incites violence, terrorism or self-harm, or instructions for weapons.
• Hate speech: content that attacks, demeans or incites hatred or discrimination against people based on race, ethnicity, nationality, religion, gender, sexual orientation, disability or other protected characteristics.
• Child-unsafe content (CSAM): any sexual or sexualized content involving minors, or any content that endangers children. We have zero tolerance and report such content to the relevant authorities.
• Deepfakes / impersonation: synthetic images, video or voice of a real person made without their consent, content that impersonates real people, brands or organizations, or content intended to mislead people about its origin or authenticity — including non-consensual intimate imagery and political disinformation.
• Copyright / trademark infringement: content that infringes others' copyrights, trademarks, publicity or privacy rights, including uploading material you have no right to use.

10.3 Prohibited conduct. You also must not:

• generate illegal, defamatory, harassing, fraudulent or deceptive content, spam or scams;
• create malware, phishing content or tools for attacking systems;
• try to bypass, disable or interfere with safety filters or security features, including with jailbreak prompts, or switch models to get around a refusal;
• use Inputs, Outputs or model responses to train, fine-tune, benchmark or distill an AI model that competes with the Service, or scrape Outputs at scale beyond your own authorized use;
• present AI-generated content as the work of a licensed professional (such as a doctor, lawyer or financial adviser) where this could cause harm, or pass off AI-generated content as human-made in order to deceive;
• resell or sublicense access to the Service or your API keys without our prior written approval;
• violate any applicable law, regulation or card-network rule.

10.4 Content moderation. Every generation request passes through the safety systems of the third-party model provider that runs it; requests and Outputs they flag are blocked and are not charged. We also review content that is reported to us or that comes to our attention through abuse signals, and may block, remove or restrict content and accounts that violate this policy. Your works are private to your account by default; we do not publish them in a public gallery.

10.5 Reporting. If you see content created with the Service that violates this policy, or content that infringes your rights or impersonates you, email jameswest8823@gmail.com with the subject "Report", a link or description of the content, and the reason. We will acknowledge reports within 2 business days. Reports involving child safety or imminent harm are handled first, within 24 hours. Reporter identity is kept confidential.

10.6 Enforcement. Depending on how serious the violation is, we may: issue a warning; remove the content; restrict access to certain models or features; suspend the account; permanently ban the account and forfeit its remaining credits (see section 6.2); and report illegal content, in particular child sexual abuse material, to law enforcement.

10.7 Appeals. If you believe we made a mistake, you can appeal within 30 days by emailing jameswest8823@gmail.com with the subject "Appeal". We will review the decision again and reply within 10 business days.

11. Data, privacy and security

Your use of the Service is governed by our Privacy Policy (https://tvvv.net/privacy). Payment card data is handled exclusively by our PCI-DSS compliant payment processors (Stripe and, where indicated at checkout, Waffo Pancake) and is never stored on our servers. After an account is deleted, its data is deleted within 30 days, except records we must keep by law, as described in the Privacy Policy.

12. Disclaimers and limitation of liability

12.1 Disclaimer. The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability or the accuracy of AI Outputs.

12.2 AI-generated content. AI Outputs may be inaccurate, incomplete or out of date. Do not rely on them as legal, medical, financial or other professional advice; always check with a qualified professional before acting on AI-generated content.

12.3 Limitation of liability. To the maximum extent permitted by law, TVVV is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

12.4 Indemnity. You agree to indemnify us against claims arising from your Inputs, your use of Outputs or your breach of these Terms.

13. Term and termination

These Terms apply for as long as you use the Service. We may suspend or terminate your account if you seriously or repeatedly breach these Terms, if we reasonably suspect fraud or abuse, or if the law requires it. You can stop using the Service at any time and can ask us to delete your account by emailing jameswest8823@gmail.com from your account email. Section 6.2 explains what happens to remaining credits.

14. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China (for the purpose of these Terms, excluding the laws of the Hong Kong SAR, the Macao SAR and Taiwan). If a dispute arises, please first contact us at jameswest8823@gmail.com so we can try to resolve it through friendly negotiation within 30 days. If negotiation fails, either party may bring the dispute before the people's court with jurisdiction where the operator is located, namely the competent court in Yuhang District, Hangzhou (the People's Court of Yuhang District, Hangzhou). If you are a consumer in the EU, the UK or another country whose law gives you mandatory consumer protections, nothing in this section deprives you of those protections or of your right to bring a claim in the courts of the country where you live where that law requires it.

15. General

We may update these Terms from time to time. For material changes we will notify you by email or on the Service at least 14 days before they take effect. Continuing to use the Service after the effective date means you accept the changes. If any provision is found invalid, the remaining provisions stay in full force. These Terms and the Privacy Policy are the entire agreement between you and TVVV regarding the Service. We may assign these Terms in connection with a merger or sale of the business; you may not assign them without our consent.
